Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the Selective Edge platform at selective-edge.com.au and any related services (together, the "Service"), operated by Yathushan Muraleetharan (ABN 38 917 736 686) ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

The Service is intended for use by parents and legal guardians of children in Years 4–6 who reside in Australia. By creating an account you confirm that:

  • You are at least 18 years of age;
  • You are the parent or legal guardian of any student profile you add;
  • You consent to your child using the Service under your account; and
  • The information you provide is accurate and current.

Children do not create accounts directly. They use the Service through a student profile inside a parent account.

3. What the Service does

Selective Edge provides timed practice exams, automatic marking of multiple-choice questions, a daily personalised study plan, and writing pieces marked by human tutors against a 5-criterion rubric. The Service is designed to help students prepare for the NSW Selective High Schools Placement Test, but is not affiliated with, endorsed by, or produced in cooperation with the NSW Department of Education or the official test administrators.

4. Your account

You are responsible for keeping your account credentials confidential and for activity that occurs under your account. Notify us promptly if you suspect unauthorised access. We may suspend or terminate accounts that breach these Terms.

5. Plans, payment and cancellation

  • Free plan: available indefinitely. Limited to one full timed exam per subject per week.
  • Standard and Pro plans: billed monthly or annually in advance, in Australian dollars, via Stripe. Annual plans receive a discount published on the Pricing page.
  • Cancellation: you may cancel a paid plan at any time from your account. Cancellation takes effect at the end of the current billing period; access continues until that point.
  • Refunds: outside the consumer guarantees described below, payments are non-refundable. We will of course honour any rights you have under the Australian Consumer Law that cannot be excluded.

6. Acceptable use

You agree not to:

  • Share account credentials or allow other families to use your account;
  • Copy, redistribute or republish question content or tutor feedback;
  • Attempt to extract the question bank by automated means;
  • Interfere with the security or operation of the Service;
  • Use the Service for any unlawful purpose.

7. Intellectual property

All practice questions, diagrams, explanations, rubrics and writing prompts on the Service are original works owned by Selective Edge or licensed to us, and are protected by Australian and international copyright. You receive a personal, non-transferable licence to access this content for your own family's preparation while your account is active. Reproduction, public display, or redistribution is prohibited without our written permission.

Writing pieces submitted by your child remain owned by your child. By submitting them you grant us a licence to mark them, store them, and use anonymised excerpts to improve the Service.

8. Tutor marking

Writing submissions are marked by human tutors using a 5-criterion rubric. We aim for a tutor turnaround of 48 hours or less. The marking is a professional assessment by experienced tutors, but it is not an official examination or a guarantee of results in any real test. Educational outcomes depend on many factors outside our control.

9. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms is intended to exclude, restrict or modify the application of any consumer guarantee that applies under that law. To the extent permitted, our liability for breach of any consumer guarantee is limited to resupplying the service or refunding the price paid.

10. Limitation of liability

To the maximum extent permitted by law and subject to the section above:

  • The Service is provided "as is" and we make no warranties about uninterrupted availability, error-free operation, or particular outcomes;
  • We are not liable for indirect, consequential, special or punitive damages, including loss of data, loss of opportunity or any educational outcome; and
  • Our total aggregate liability arising out of or in connection with the Service is limited to the fees you paid us in the 12 months preceding the claim.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that breach these Terms, with or without notice depending on the severity of the breach. On termination, your right to access the Service ends; data retention is described in our Privacy Policy.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified to account holders by email and the "Last updated" date above will be revised. Continued use of the Service after the update constitutes acceptance.

13. Governing law

These Terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales.
